LIGHT-HUB TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the Light-Hub websites, apps, and related platforms (“Light-Hub” or the “Service”). Please read these Terms carefully, and contact us if you have any questions. By accessing or using Light-Hub, you agree to be bound by these Terms, our Privacy Policy, and our Cookies Policy.

 

1.     Our Service

 

Light-Hub aims to help designers, architects, contractors and consultants easily search, select and procure their architectural luminaire needs for their projects. To do that, we developed a single centralized platform, Light-Hub, that would allow various trusted lighting brands and suppliers to showcase their luminaire products to our platform and have those available for searching, filtering, product selection and consolidation by our users into their own Luminaire Schedule. Users can then either use their generated luminaire schedules to directly contact suppliers or have the suppliers contact them if they opted to do so. The hope is for Light-Hub to improve the lives of designers and consultants alike and then revolutionize the lighting industry in the process.

 

More simply put

Light-Hub helps you search architectural luminaires and generate luminaire schedules for your project. We partnered with trusted brands to bring you the latest products in the lighting industry.

 

2.     Using Light-Hub

 

A.     Who can use Light-Hub

 

You may use Light-Hub only if you can legally form a binding contract with Light-Hub, and only in compliance with these Terms and all applicable laws. When you create your Light-Hub account, you must provide us with accurate and complete account information. You can’t use Light-Hub if it would be prohibited by the sanctions applicable to your country of residence. Any use or access by anyone under the age mandated by the law in your country is not allowed. If you’re based in the EEA, you may only use Light-Hub if you are over the age at which you can provide consent to data processing under the laws of your country.

 

B.     Creating an Account in Light-Hub

 

To user our Light-Hub Services, you must first create an account with us by completing the account registration form available on our website. When creating an account, you must provide us with accurate and complete contact information, including your name, the name of your company, and your email address (“Account Information”). It is your responsibility keep your Account Information up to date so that we can contact you, if necessary.

 

Upon registration, you will be asked to select and enter a password for your account. Such password is personal to you as the sole authorized User of that account. You must keep your password secure and confidential at all times and should not share them with any third party. If you suspect that your password has been compromised or is disclosed to authorized party, you should immediately change your password and/or contact us immediately should you fail to do so. Any activity which takes place through your account will be deemed to have been carried out by you and you agree to indemnify and keep us fully and effectively indemnified against any loss, damage, cost (including reasonable legal fees) that may arise out of or in relation to any unauthorized use of your account.

C.     Account Creation Subject to Approval

 

The registration of your account is subject to approval by us in all cases, and we reserve the right, in our sole and absolute discretion, to decline and application for registration, without the need to provide a reason. You will receive an email notification from us once we have approved your registration. Once you have verified your account and has been approved by us, you will now have full access to Light-Hub.

 

D.     Our License to You

 

Subject to these Terms and our policies, we grant you a limited, non-exclusive, non-transferable, and revocable license to use our Service.

 

3.     Products and Content on the Website

 

Light-Hub sources the products and related product information made available in the Light-Hub website directly from its partner suppliers through the development of an Application Programming Interface (API) or similar application / platform that allows us to fetch and integrate product data from the supplier system. The supplier owns the images and related information of their product displayed in our website.

 

While we endeavor to provide the latest and most accurate product information directly from our partner-suppliers, we cannot and do not guarantee that the information made available in Light-Hub reflect the latest information and we should not be held liable for any inaccuracies as a result thereof. It is your responsibility as user to verify the information with our partner-suppliers should you proceed with the procurement of products with them.

 

4.     Your Content

 

Light-Hub allows you to filter and select luminaires from our product catalog and then allows you to automatically compile the same into a custom Luminaire Schedule for your projects (“User Content”). Your User Content is not posted and made available to other Users. However, at your discretion, you can email and share your User Content to other recipients. You retain all rights in, and are solely responsible for, the User Content you generate in Light-Hub. However, your User Content together with your personal information may be shared to third party subject to the provisions of our Privacy Policy.

 

5.     Placing Order for Luminaire Selections

 

Light-Hub mainly allows you to generate Luminaire Schedules for your project out of your selections from our product catalog. Light-Hub DOES NOT currently allow you to place orders directly to suppliers through our platforms. Our agreement with our partner suppliers only extends up to the display of their luminaires to Light-Hub as an extension of their marketing initiatives and does not cover any procurement related transactions between them and our users.

 

At your discretion, you may contact the suppliers directly through their contact information and may use the Luminaire Schedules you generated in our website to facilitate the procurement transaction. Alternatively, and subject to the terms of service as well as the privacy policy outlined in our website, our partner-suppliers may directly contact you, outside of our platform, through your provided contact information to further discuss your project and how they may offer their products and services to facilitate the completion of the same. All quality, price and related contract negotiations between you and the supplier is outside the scope of our Service. Light-Hub should not be held liable for any disputes or claims arising from such negotiations or external discussions.

 

6.     Third party links, sites, and services

 

Light-Hub may contain links to third party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by us. We don’t endorse or assume any responsibility for any such third party sites, information, materials, products, or services. If you access any third party website, service, or content from Light-Hub, you do so at your own risk and you agree that Light-Hub has no liability arising from your use of or access to any third party website, service, or content.

 

7.     Limitation of Liability

 

To the maximum extent permitted by law, Light-Hub shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any conduct or content of any third party on the service, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties; or (c) unauthorized access, use or alteration of your transmissions or content. In no event shall Light-Hub's aggregate liability for all claims relating to the service exceed One Hundred Dirhams (AED 100.00).

 

8.     Governing Law and Jurisdiction

 

Any dispute or claim arising out of or in connection with these Terms of Service shall be governed by and construed in accordance with the laws of the United Arab Emirates (“UAE”) and the courts of UAE shall have exclusive jurisdiction to settle any such dispute or claim.

 

9.     Changes to the Terms

 

We reserve the right, at our sole discretion, to revise or replace these Terms at any time. The most current version will always be posted in our website. If a revision is material, we will notify you. We reserve the right to determine the form and means of providing notifications to you, and you agree to receive legal notices electronically if should we decide to do so. What constitutes a material change will be determined at our sole discretion. By continuing to access or use Light-Hub after revisions become effective, you agree to be bound by the new Terms. If you don’t agree to the new terms, you have the option to stop using our Service.
